Neste artigo apresenta-se o significado do conceito de sociabilidade insociável e de sua importância para a filosofia histórico-política de Kant. Defendem-se aqui duas teses importantes: primeira, que esse conceito se insere essencialmente num paradigma biológicoteleológico em vez de físico-mecânico; segunda, que a insociabilidade deve ser compreendida como se referindo a inclinações e não a paixões, o que, por sua vez, permite pensá-la em concordância com um progresso moral também dos indivíduo.

Este artigo analisa a teoria da democracia de Carl Schmitt e procura destacar, a partir disso, suas virtudes e deficiências. O texto é dividido em duas partes. Na primeira sustenta-se que a teoria schmittiana de democracia se desenrola em dois níveis diferentes, um nível conceitual, essencialmente analítico, e um nível fenomênico, que segundo Schmitt seria meramente descritivo. Este trabalho apresenta uma interpretação abrangente e sistemática do significado e da legitimidade dos conceitos de precisão, interesse, esperança e crença no interior da filosofia kantiana. A análise desses conceitos está diretamente vinculada à discussão acerca da natureza da razão prática pura, da legitimidade do conceito de sumo bem e da unidade arquitetônica da razão. ABSTRACT In this paper, I argue that the idea of a universal history is systematically legitimized in Kant’s transcendental system of philosophy by way of the concept of a need [Bedürfnis] for pure practical reason. In this sense, the idea of a universal history is a fundamental part of the moral image of the world that emerges from Kant’s whole philosophy, and it is crucial for understanding both the possibility of the system of pure reason, as well the full development (...) of Kant’s moral philosophy, especially for political philosophy. RESUMO Nesse artigo eu argumento que a ideia de uma história universal é sistematicamente legitimada no sistema da filosofia transcendental de Kant por meio do conceito de precisão [Bedürfnis] da razão pura prática. In this article I argue that the current readings of permissive law fall into hermeneutical difficulties and do not completely explain Kant’s complex use of the concept. I argue that the shortcomings of these interpretations can only be overcome by relating permissive law to practical teleology. That teleological thinking has a role in Kant’s moral thought by way of history is not new. Here, however, I argue that the system of rights itself is in some manner teleologically situated. Este artigo apresenta os aspectos liberais e republicanos da filosofia política de Rousseau e defende que eles devem ser interpretados como complementares. Entretanto, essa complementaridade pode ser caracterizada num sentido específico, qual seja, como sendo um liberalismo republicano.

Neste artigo fazem-se algumas considerações sobre a justificação da propriedade privada na filosofia do direito de Kant. A partir da análise do conceito de lei permissiva da razão, defende-se que na filosofia do direito opera uma perspectiva teleológico- reflexionante de caráter prático, a qual permite compreender, por um lado, que a propriedade no estado de natureza seja legítima ao mesmo tempo em que é problemática, enquanto, por outro lado, o estado civil envolve a exigência de que a propriedade seja adequada (...) segundo as condições de um sistema de justiça distributiva. In this paper I defend three different points: first, that the concept of highest good is derived from an a priori but subjective argument, namely a maxim of pure practical reason; secondly, that the theory regarding the highest good has the validity of a practical regulative knowledge; and thirdly, that the practical regulative knowledge can be understood as the same “holding something to be true” as Kant attributes to hope and believe.

No primeiro momento, apresentam-se as semelhanças e diferenças acerca do modo como cada autor compreende o estado de natureza. : In this paper, I shall defend the thesis that the idea of a universal history in Kant’s third Critique is not legitimated from a theoretical and systematic point of view but instead from a practical point of view. In order to sustain this interpretation, I shall reconstruct parts of arguments from the entire Critique of Teleological Judgment. First, I shall argue that in the Analytic as in the Dialectic, the external purposiveness can legitimize only a teleological history of nature (...) but not a universal history. Este artigo apresenta e analisa as principais teses que constituem a concepção de educação cívica de Rousseau. Além disso, faz-se considerações críticas acerca da proposta político-pedagógica de Rousseau, apontando tanto para elementos equivocados e potencialmente problemáticos, quanto indicando aspectos relevantes para se pensar questões relativas a política e a educação.

Neste artigo faz-se uma comparação entre a perspectiva metodológica e epistemológica desenvolvida por Bacon no Novum Organum e por Kant na Crítica da razão pura. Nesse sentido, defende-se que apesar de não se poder ignorar as divergências com relação ao modo como cada filósofo desenvolve a delimitação dos seus conceitos de conhecimento e de ciência, ainda assim é possível encontrar importantes elementos de convergência tanto com relação à ilusão transcendental e outras formas de erros no que concerne a teoria dos (...) ídolos, quanto com relação à perspectiva metodológica subjacente ao conceito de experiência e experimento. This paper defends a constructive interpretation of the Critique of Pure Reason, which is built in analogy with an experimental construction that Kant believes to characteristic of chemistry. I also argue for a way to reconcile the methodological perspective of the constructivist method with that of transcendental reflection. I therefore provide a constructive explanation for what Kant describes as being pure reason and the argument of the transcendental deduction. I propose to frame the different perspectives in such a way that (...) the experimental construction is the ratio cognoscendi of pure reason, while pure reason is the ratio essendi of the experimental construction. O’Neill (1989, 2015) is one of the most important scholars that have argued for a constructivist reading of the Critique of pure reason (CPR). In this paper I develop and explore new aspects of this line of interpretation. One of the main criticisms raised against constructivist readings of Kant’s philosophy is an alleged commitment to subjectivism or voluntarism (cf. Kleingeld & Willaschek 2019). This concern led some scholars to rename their position as constitutivist instead (Korsgaard 2009; Sensen 2013, 2017; Formosa 2011). Constitutivism, is intended to be a sort of constructivism capable of avoiding voluntarism. However, it becomes difficult, sometimes, to differentiate between the constitutivist and foundationalist positions, which are based on transcendental reflection and imply a sort of realist perspective on reason. The same preoccupation applies to the constructivist interpretation of the CPR. In order to deal with this issue, the following questions must be addressed: how can constructivism justify the necessity and universality of transcendental principles of pure reason without compromising the normative and procedural aspects of the construction? How to reconcile arguments based on the analysis of representations and faculties with a constructivist procedure? Or even, how may transcendental reflection, as a view of the possibility of a priori cognition, be rendered compatible with a constructive procedure? This paper is divided into three sections, followed by brief final remarks. The first section outlines the main characteristics of constructivism and relates them to Kant’s positions about the nature of philosophy and its method. The second part argues for a type of experimental constructivism that might serve as a guiding analogy to understand the method underlying the CPR. Thirdly, I will show how the transcendental subject and pure reason are derived from this experimental construction. The conclusion briefly points out some advantages of this position. (shrink)

In this paper I argue that Kant’s political and juridical philosophy justifies a type of normative legal positivism that implies specific notions of law and legal freedom which determine and restrict the sphere of action of judges and jurists. Finally, I defend that, according to Kant’s practical philosophy, the normative connection between justice and law is not supposed to be carried out at the juridical level, as a meta-juridical theory, but at the political one, making it a meta-political theory.

A argumentação desenvolvida no presente artigo se propõe a defender a interpretação austera do construtivismo em Kant das objeções a ela levantadas por Jeremy Schwartz (2017) em seu artigo _Was Kant a ‘Kantian Constructivist’?_. Tendo isso em vista, primeiramente, procede-se à reconstrução da interpretação de Schwartz para a distinção analítico-sintética na esfera prática a partir da caracterização por contradição e à indicação de objeções para sua aceitação. Na sequência, apresenta-se a caracterização de analiticidade por continência e como esta pode ser (...) transposta para o caso dos imperativos sem resultar em conflitos com a interpretação austera do construtivismo. Por fim, delineiam-se considerações quanto à formalidade dos princípios constitutivos da razão prática e seu escopo, chegando à conclusão de que não se pode estabelecer uma identidade entre construtivismo austero e logicismo prático. This essay shows how Kantian philosophy provides relevant grounds for reflections regarding the current debate on democracy. Firstly, I argue that representative democracy has a particular moral value that stands out the other forms of government. Secondly, I make some considerations about the elements that must be institutionally embodied in order to ensure a proper functioning democracy, such as the separation of powers, the guarantee of a public sphere which is appropriate to the freedom of public use of reason, the (...) moral requirement of veracity in the performance of public agents; the participationism, the reformism and, finally, the cosmopolitanism. Diante do lema “sapere aude”, com o qual Kant apresenta sua caracterização de esclarecimento, colocaseimediatamente a questão: o que signifi ca pensar por si mesmo? Apesar de Kant procurar respondera isso ao longo do texto, muitas difi culdades permanecem enquanto as teses ali defendidas não foremintegradas no horizonte da fi losofi a crítico-transcendental. Em primeiro lugar, mostra-se como o esclarecimentoé uma noção ambivalente, por um lado se refere ao indivíduo, por outro, se refere a uma época.Em segundo lugar, o esclarecimento (...) implica essencialmente uma mudança no método e não necessariamenteno conteúdo do pensamento, nesse sentido, o esclarecimento exige um determinado modo depensar , que se caracteriza pela disposição de se fazer um uso público da razão, ou seja, adisponibilidade pública de pedir e oferecer razões para justifi car determinada posição. Em terceiro lugar,defende-se que na expressão “fazer uso de teu próprio entendimento”, o termo entendimento deve serinterpretado em um sentido lato, isto é, de forma a abarcar tanto a razão no seu uso teórico quanto noseu uso prático. Mais do que isso, defende-se que o principal objetivo do Esclarecimento, segundo Kant,é o estabelecimento de um modo de pensar autônomo em sentido moral. Perpassando todos esses trêspontos, evidencia-se a importância desempenhada pela fi losofi a, seja enquanto aquela que deve zelarpelos princípios do uso público da sã razão, seja enquanto doutrina da sabedoria.Facing the dilemma “sapere aude”, with which Kant introduces his enlightenment characterization, immediately appears the question: what means to think by oneself? Despite Kant tries to answer to that along the text, many dif culties will remain while the thesis defended there are not integrated in the horizon of critical-transcendental philosophy. First, it is showed how the enlightenment is an ambivalent notion, on one side it refers to the individual, on the other, it refers to an epoch. Second, the enlightenment implies essentially a change in the method and not necessarily in the thought content, in this sense, the enlightenment demands a certain way of thinking , that is characterized by the disposition to make a public use of reason, in other words, the public availability to request and offer reasons to justify determined position. Third, it is defended that in the expression “make use of your own understanding”, the term “understanding” should be interpreted in a lato sensu, that is, in order to taking into account the reason in its theoretical as well as in its practical use. Furthermore it is defended that the main goal of Enlightenment, according to Kant, is to establish an autonomous way of thinking in a moral sense. Passing by all of these three points, it stays evident the importance performed by philosophy, both as the one that should look after the principles of the public use of the sane reason, and as wisdom doctrine. Defende-se que o conceito de esperança no progresso da humanidade é de fundamental importância para a compreensão da filosofia política de ambos os autores. Por um lado, esperança oferece um horizonte de sentido que protege suas propostas políticas de visões de mundo antagônicas; por outro, ela se incorpora no próprio projeto político tendo ao mesmo tempo a função de motivação e de criação de instituições políticas com caráter (...) pedagógico. This paper analyses the concept of hope in the works of Condorcet and Kant. It will be advocated that the concept of hope in the progress of humanity is of great importance for the comprehension of the political philosophy of both authors. On the one hand, hope gives a horizon of meaning to political philosophy that protects it against antagonistic world views. On the other hand, hope is incorporated into the political philosophy itself having, at once, a motivational function and creation of political institutions with a pedagogical character, as well. This book investigates several dimensions of the concept of cosmopolitanism since Kant. The first of these dimensions is a world vision that considers the construction of a 'cosmopolitan self' as a question of justice. The second is the idea that a local political-legal order is fully democratic only if it respects the environment and the human rights of all people of the world, regardless of their citizenship. The third dimension concerns the practice of crossborder associations between individuals, institutionalized or not (...) (cosmopolitics, as Balibar called it). The fourth considers individuals as subjects of international law, as in the case of individual petitions concerning human rights through the European Court of Human Rights and individual responsibility in international criminal law. This paper analyses the relationship between Rousseau’s political philosophy and the concept of democracy, while focusing on the debate about the admissibility of deliberation and discussion at the assemblies. After presenting different readings of Rousseau’s views of deliberation, we advocate from a distinction drawn between debate and discussion that the central goal of Rousseau’s political philosophy is not to avoid public deliberation, but to avoid or mitigate the influence of rhetoric in the public space. Throughout the paper, we also point (...) out a series of comparisons between Rousseau’s democratic theory and ancient and contemporary political ideas, in this case, those of philosophers such as Plato, Tocqueville, Schmitt and Kelsen. Virtue ethicists argue that modern ethical theories aim to give direct guidance about particular situations at the cost of offering artificial or narrow accounts of ethics. In contrast, virtue ethical theories guide action indirectly by helping one understand the virtues—but the theory will not provide answers as to what to do in particular instances. Recently, this had led many to think that virtue ethical theories are self-effacing the way some claim consequentialist and deontological theories are. In this paper I defend (...) virtue ethics against the charge of self-effacement. I distinguish between modestly self-effacing theories, immodestly self-effacing theories and theories that recommend indirect guidance. Though all self-effacing theories are indirect, not all indirect theories are self-effacing. I argue that virtue ethics is not self-effacing, but rather indirectly action-guiding. The response I articulate draws on the distinctive virtue ethical mode of action-guidance: namely, that thinking hard about virtue and what kind of person one aims to be offers the kind of guidance we want (or should want) as we face practical moral problems. In the Gorgias, Plato has Polus ask Socrates if he would rather suffer injustice than perform it. Socrates’ response is justly famous, affirming a view that Polus himself finds incredible, and one that even contemporary readers find difficult to credit: “for my part, I would prefer neither, but if it had to be one or the other, I would choose to suffer rather than do what is unjust”. In this paper, we take up the part of Socrates’ response that Polus (...) never engages and that has also been completely neglected by contemporary scholars, namely, Socrates’ explicit aversion to being a victim of injustice. We show that this same aversion—though one not nearly as strong as his aversion to doing injustice—appears in several texts, and we argue that the best explanation of such an aversion derives from two important features of Socratic philosophy, both of which have only recently been recognized in Socratic scholarship: his virtue intellectualism, which conceives of virtue as a kind of craft that can be achieved in different degrees, and his conception of moral psychology, which allows for non-rational influences on how we perform the cognitive functions required for proper deliberation. Next SectionObjectives To evaluate the adequacy of paediatric informed consent and its augmentation by a supplemental computer-based module in paediatric endoscopy. Methods The Consent-20 instrument was developed and piloted on 47 subjects. Subsequently, parents of 101 children undergoing first-time, diagnostic upper endoscopy performed under moderate IV sedation were prospectively and consecutively, blinded, randomised and enrolled into two groups that received either standard form-based informed consent or standard form-based informed consent plus a commercial (Emmi Solutions, Inc, Chicago, Il), sixth grade level, (...) interactive learning module (electronic assisted consent). Anonymously and electronically, the subjects' anxiety (State Trait Anxiety Inventory), satisfaction (Modified Group Health Association of America), number of questions asked, and attainment of informed consent were assessed (Consent-20). Statistics were calculated using t test, paired t test, and Mann Whitney tests. Results The ability to achieve informed consent, as measured by the new instrument, was 10% in the control form-based consent group and 33% in the electronic assisted consent group (p<0.0001). Electronically assisting form-based informed consent did not alter secondary outcome measures of subject satisfaction, anxiety or number of questions asked in a paediatric endoscopy unit. Conclusions This study demonstrates the limitations of form-based informed consent methods for paediatric endoscopy. It also shows that even when necessary information was repeated electronically in a comprehensive and standardised video, informed consent as measured by our instrument was incompletely achieved. The supplemental information did, however, significantly improve understanding in a manner that did not negatively impact workflow, subject anxiety or subject satisfaction. In this paper, I argue against the claim that in Plato's Republic the most important distinguishing feature between the philosopher and non-philosopher is that the philosopher has knowledge while the non-philosopher has, at best, true opinion. This claim is, in fact, inconsistent with statements Plato makes in later books of the Republic. I submit that the important distinction Plato makes concerns the type of knowledge possessed by the philosopher-ruler. As a result, we need to amend widely held scholarly interpretations of (...) important passages in the Republic ; most notably the passages containing the Sun, Line, and Cave. I consider the views of a number of important scholars and suggest a proposal that avoids this inconsistency with the text. An important consequence of my argument is that Philosophers are indeed not the only ones with knowledge in the Kallipolis. (shrink)

Why hasn’t democracy been embraced worldwide as the best form of government? Aesthetic critics of democracy such as Carlyle and Nietzsche have argued that modern democracy, by removing the hierarchical institutions that once elevated society’s character, turns citizens into bland, mediocre souls. Joel A. Johnson now offers a rebuttal to these critics, drawing surprising inspiration from American literary classics. Addressing the question from a new perspective, Johnson takes a fresh look at the worth of liberal democracy in these uncertain (...) times and tackles head-on the thorny question of cultural development. Examining the novels of James Fenimore Cooper, Mark Twain, and William Dean Howells, he shows that through their fiction we can gain a better appreciation of the rich detail of everyday life, making the debate relevant to contemporary discussions of liberal democracy. Johnson focuses on an issue that liberals have inadequately addressed: whether people tend to develop fully as individuals under liberal democracy when such a regime does little formally to encourage their development. He argues that, though the liberal fear of state-guided culture is well founded, it should not prevent us from evaluating liberalism’s effect on individual flourishing. By extending the debate over the worthiness of liberal democracy to include democracy’s effect on individual development, he contends that the democratic experience is much fuller than the aristocratic one and thus expands the faculties of its citizens. Critics of American democracy such as John Rawls have sought to transform it into a social or egalitarian democracy in the European style. Johnson shows that neither the debate between Rawls and his communitarian critics nor the ongoing discussion of the globalization of American values adequately addresses the fundamental critique of democratic culture advanced by the aesthetic critics. Johnson’s cogent analysis reaches out to those readers who are ready for a more comprehensive evaluation of liberal democracy, offering new insight into the relationship between the state and the individual while blazing new trails in the intersection of politics and literature. According to the standard Aristotelian doctrine of the identity of passion and action (Ipa), a passion and the action with which it is identified are distinguished through a distinction of reason, and both passion and action are located in the patient. Descartes has recently been interpreted by some scholars to be rejecting Ipa in favor of a view that throws into contention a dualistic interpretation of his philosophy of mind. This article contends that Descartes did hold Ipa, albeit expressed in (...) his own metaphysical vocabulary of substance and mode. On this interpretation, (1) a passion and the action with which it is identified are distinguished through a conceptual distinction or distinction of reason and (2) the passion and the action constitute one and the same mode which is locatedin the patient. This result is significant first, because it shows Descartes's retention of a fundamentally Aristotelian understanding of the metaphysical categories of passion and action and second, because it removes some of the support for recent interpretations on which Descartes is seen in the Passions of the Soul to diverge from a dualistic view of mind and body. Respect and self-respect are the cornerstone motivations in Kantian moral psychology. But “respect” is an ambiguous term. As Stephen Darwall has argued, sometimes respect refers to a constraint on practical reason, but at other times it refers to a person-directed pro-attitude. In this article, I argue that this distinction is a problem regarding self-respect since self-respect, in the latter sense, lacks warrant. Furthermore, I discuss Nietzsche’s conception of “self-reverence,” which in some ways serves as a replacement for Kantian self-respect in (...) the pro-attitude sense. I argue that, in Nietzsche’s view, the value that a person anticipates and aspires to realize in the future warrants self-reverence, even in cases where the person cannot fully articulate this value. This kind of self-directed value is what Nietzsche means when he claims in Beyond Good and Evil §287, “The noble soul has reverence for itself.”. (shrink)

In the preface to GS, Nietzsche famously exclaims, "Those Greeks were superficial—out of profundity!".1 And he attributes one aspect of this profound superficiality to the Greeks' "respect for the bashfulness [Scham] with which nature has hidden behind riddles and iridescent uncertainties". For Nietzsche, both the Greeks' shame and their respect for shame played important and healthy psychological and social roles. So, Nietzsche praises shame in the sense that "care [Scham] for one's reputation" is characteristic of noble types and a "highly (...) resourceful" emotion. Among other things, Nietzsche considers himself a psychologist, and many of his ideas about human behaviors, dispositions, and attitudes are empirical and falsifiable. As readers of Nietzsche, we should hope that he got some of his psychological facts right. Permeabilized cell models provide an experimental middle ground wherein the in vitro properties of mechanochemical proteins can be reconciled with the physical and topological constraints of the intact cell. Several well‐studied examples of organelle motility are described here, including the actin‐based cytoplasmic streaming of Characean algae, the microtubule‐based aggregation and dispersion of pigment granules in chromatophores and the saltatory movements of vesicles along microtubules in fibroblasts and macrophages. In this thesis, I focus on two undervalued aspects of Nietzsche’s admiration of the ancient Greeks: the healthy psychology of the Greeks, and the origins of this health in Homeric poetry. I argue that Homer was a cultural physician for the ancient Greeks and is responsible for creating a new, healthy set of values through his epic poetry. In turn, these Homeric values brought Greece into its “tragic age”—a time during which Greek culture was “the highest authority for what we (...) may term cultural health”. Moreover, Homer’s success as a cultural physician comes from his ability to lie poetically lie. So, I also give an account of how Nietzsche thinks this kind of lying is psychologically possible through what I call Nietzschean dissimulation. (shrink)

I argue that, on a dispositionalist account of causation and indeed on any other view of causation according to which causation is a real relation, general relativity does not give causal principles a role in explaining phenomena. In doing so, I bring out a surprisingly substantial constraint on adequate views about the explanations and ontology of GR, namely the requirement that such views show how GR can explain motion that is free of disturbing influences.

No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

The so-called “dark room problem” makes vivd the challenges that purely predictive models face in accounting for motivation. I argue that the problem is a serious one. Proposals for solving the dark room problem via predictive coding architectures are either empirically inadequate or computationally intractable. The Free Energy principle might avoid the problem, but only at the cost of setting itself up as a highly idealized model, which is then literally false to the world. I draw at least one optimistic (...) conclusion, however. Real-world, real-time systems may embody motivational states in a variety of ways consistent with idealized principles like FEP, including ways that are intuitively embodied and extended. This may allow predictive coding theorists to reconcile their account with embodied principles, even if it ultimately undermines loftier ambitions. (shrink)

This paper argues that the political adage “Be ye prudent as serpents and guileless as doves” involves three different types of relation between prudence and morality, namely: unification (Vereinigung), subordination (Unterordnung), and association (Beigesellung). I maintain that these relations are set up according to the same principle that determines the relationship between mechanical and teleological causality in the third Critique. Thus, I argue that morality and prudence are much more systematically related within the system of critical philosophy than is normally (...) assumed in the literature and that this is made possible by way of an intimate relationship between prudence and teleological judgment.
